GENERAL CONDITIONS

 

All prices indicated in our General Conditions are without taxes applied.

 

BUDGET / ORDER

The client’s request for a quote does not imply the formalization of an order and, therefore, the reservation of any material.

For services with transportation, the minimum material order is €250 (transportation included)

To formalize an order, it is necessary to accept the budget through reliable communication by the client, by any of the channels that Tot Hostelería BCN S.L. has enabled at any time. It will also be necessary for the client to comply with the payment and deposit conditions established in the budget. Tot Hostelería BCN S.L. reserves the right not to provide the service in the event of non-compliance with this payment obligation.

Unless expressly agreed with the client, the material collection and/or delivery services indicated in the order will always be carried out within the working hours of Tot Hostelería BCN, S.L. In the event that the services must be carried out outside these hours, the amounts derived from night fees, festivities and/or any other cost incurred in the order closed with the client will be reflected in the client’s order.

The transportation service is not included in the rental price of the material. Said service must be expressly requested, indicating the date of the event, place of delivery and collection, times, and, where appropriate, access difficulties (stairs, grass, areas not passable by vehicles, ramps, unevenness…) The value of the postage indicated in The budget is estimated, any difficulty not notified may lead to a variation in the amount to be invoiced with respect to the budgeted value.

Assembly, disassembly and/or packaging services are not included in the material rental price. These services must be expressly requested and their value will be reflected in the budget as an estimate. Any unnotified difficulty may lead to a variation in the amount to be invoiced with respect to the budgeted value.

The acceptance of an order by the client implies that he knows, accepts without reservation and is bound by these General Conditions.

 

AVAILABILITY / RESERVATION OF MATERIAL

Acceptance of the quote will entail the reservation of the material requested by the client during the date or dates agreed upon for the event. Tot Hostelería BCN S.L. will raise the budget upon request after confirming the availability of the material requested by the client.

Tot Hostelería BCN, S.L. declines any responsibility regarding the availability and supply of the material if it is affected by causes of force majeure, both its own (such as damage, loss, theft of material,…) and those of others (strikes, measures imposed by any Government or competent body, disasters). natural disasters, traffic incidents, delays in supplier deliveries…) If any of these circumstances occur, Tot Hostelería BCN S.L. may offer alternative material similar to that requested or, if the event cannot be held, the refund of the amounts paid by the client.

Less than 96 hours until the event takes place:

For requests to modify the service downwards, TOT HOSTELERÍA BCN, SL may apply a cost of 5% (with a minimum of €80) in order to cover the extra costs corresponding to the disassembly of orders already prepared to remove the material. spare.
For requests to modify the service upwards, an additional amount will be charged depending on the changes requested.

REQUEST AND RETURN OF DEPOSIT

Hiring a service will require the deposit of an amount as a guarantee to cover damage and/or loss of the rented material during the celebration of the event requested by the client.

This deposit will be returned to the client once the material has been checked and reviewed by Tot Hostelería BCN SL under the following premises:

That there are no outstanding debts from the client for this or other services already performed. In which case, up to the total debt may be retained as a payment guarantee.
That the material is received without defects or faults. In which case the deposit would be returned in full.
If there is missing material or it is in a state that does not allow it to be rented again, the amount corresponding to the value of the affected material will be deducted from the deposit according to our current replacement rates.
In the event that the amount corresponding to the value of the missing or damaged material exceeds the amount of the deposit provided by the client, the part that exceeds the deposit will be invoiced to the client according to the current replacement rates.

WAY TO PAY

Except for a written agreement between the client and Tot Hostelería, the default payment method is as follows:

50% of rental budget as a material reserve upon formalization of the order.
Deposit + remaining 50% of the rental budget up to 15 days before the service is performed.
Payments can be made by any of the methods that Tot Hostelería BCN S.L. has enabled at any given time. In the case of payment by bank transfer, indicate the budget and/or order number as a reference.

 

CANCELLATION POLICY

Tot Hostelería BCN, S.L. You can invoice the entire order if the cancellation request occurs less than 96 hours from the date of delivery of the material for management expenses, reservation of material and compensation for loss of opportunity. When the service is not carried out, the deposit advanced by the client will be returned.

For cancellations between 1 month and 96 hours before the event, Tot Hostelería BCN, S.L. will return the amounts advanced by the client with the exception of up to 25% of the amount of the service that will be invoiced for management expenses, material reservation and compensation for loss of opportunity.

 

MATERIAL DELIVERY

For the delivery of the material, a person in charge on behalf of the client will verify that all the requested product is received and that it is delivered clean and ready for use. This person in charge will give the go-ahead to the delivery operation and, once authorized by the client, no claim will be accepted for this concept. In the event that there is no person responsible on the part of the client, it will be understood that the client implicitly accepts that the material has been delivered complete and in perfect state of use, so no claim will be accepted for this concept.

In the event that delivery incidents occur (waiting, location changes, modifications to the agreed conditions), which are due to no fault of Tot Hostelería BCN, S.L., the client may be invoiced for the derived costs (additional hours, hours nights, festive hours and/or any other cost incurred and not provided for in the order closed with the client)

In deliveries and returns managed directly by the client (with transport outside Tot Hostelería BCN SL), the material will only be delivered if the client’s vehicle is suitable for the needs of the product to be transported. In case of doubt, you can consult the Tot Hostelería BCN SL team so that we can advise you.

 

CUSTOMER RESPONSIBILITY

Once the material is delivered to the client, they will be under their responsibility for theft, loss or damage (such as stains, burns, breaks, leaving the material outdoors, etc.) Any material that is missing or cannot be rented for future services will be invoiced. based on our current restocking rates.

The subletting or transfer to third parties of the material supplied is expressly prohibited without express authorization from Tot Hostelería BCN, S.L.

Tot Hostelería BCN, S.L. will not accept any responsibility if the material supplied, while in the customer’s possession, is used in an inappropriate, negligent manner or outside of its intended purpose.

While the items supplied are in the possession of the client, Tot Hostelería BCN, S.L. he gives them the right to use but retains his ownership at all times.

 

MATERIAL RETURN

Whether the material is collected by Tot Hostelería BCN, S.L. at the client’s facilities, as if the client returns it to the facilities of Tot Hostelería BCN, S.L., the material will be counted by staff of Tot Hostelería BCN, S.L. and a report will be issued that must be signed by a person in charge on behalf of the client. This document will reflect the losses and/or damages of the rented material (including the supplied packaging). In the event that there is no person responsible on the part of the client, it will be understood that the client implicitly accepts the losses and/or damages that, if any, Tot Hostelería BCN S.L. If for operational reasons and under express agreement with the client, all or part of the returned material cannot be counted and verified at the event location, the client implicitly accepts the losses and/or damages that, if any, Tot Hostelería BCN S.L. I present to you

The responsibility for the use and duty of care of the rented product required of the client will be considered extinguished when the returned material is reviewed, washed, prepared for new use and the client is informed of the losses and/or damage found.

In the event that there is a delay in the collection for reasons beyond the control of Tot Hostelería and that this is not due to force majeure, the client may be invoiced for the costs derived from delays, night hours, holiday hours and/or or any other cost incurred and not provided for in the order closed with the customer. In the same way, delays in the return of the material, by the client, will entail the collection of an indemnity.

 

OUTSOURCING

Tot Hostelería BCN, S.L. reserves the right to subcontract people and/or companies to carry out the services contracted by the client if required for operational reasons. In any case, they will always act on behalf of Tot Hostelería BCN, S.L. under our responsibility and supervision.

 

JURISDICTION

If any stipulation or stipulations of these General Conditions were considered invalid, illegal or impossible to comply with, the validity, legality and compliance of the rest will not be affected in any way, nor will they be modified for that reason.

 

For any doubt, question or discrepancy arising from the interpretation or execution of these General Conditions, the parties, waiving their own jurisdiction, agree to submit to the courts of Barcelona.
